1. Approve meeting minutes of April 3, 2012 and special meeting minutes of April 17 & 23, 2012

2. Introduction of an Omnibus Ordinance modifying the Municipal Code to: amend Chapter 2.32 (Parks and Recreation Commission) to correct term of chairperson; amend Title 5.12 ([Business] License and Tax Payment) to clarify definition of collector and evidence of doing business; repeal Chapter 6.16 (Drug Paraphernalia); amend Chapters 9.04 (Noise regulations) and 18.84 (Site, yard,…) to address pool and spa equipment; amend Chapter 9.20 (Garbage) about impermissible non-franchise service; amend Chapter 9.24 (Smoking …) to clarify prohibition in outdoor dining areas; amend Chapter 9.28 (Property maintenance) about parking on improved surfaces; amend Chapter 15.44 (Protection of Sanitary Sewer …) to address shared interceptors and enforcement; amend Chapter 18.08 ([Zoning] Definitions) and Chapter 18.110 (Personal Wireless…) to clarify measurement distances from support equipment versus antennas; amend Chapter 18.84 (Site, Yard, Bulk, Usable Open Space and Landscaping Regulations) to clarify home separation requirements and height limitations; and resolution to amend Master Fee Schedule to: include business license fees, reports and license change costs; and change City water connection fees for higher flow Omni C2 meters and eliminate fee for meter no longer offered

3. Approve and authorize City Manager to enter into with Urban Habitat et al. an agreement regarding February 15, 2012 meet and confer letter

5. Approve plans and specifications, review bids, and award contract to JJR Construction in the amount of $83,598 for the Annual Sidewalk and Intersection Ramp Installations project, CIP No. 115005

6. Accept or appeal actions of the Zoning Administrator and Planning Commission

7. Adopt a resolution authorizing an application with the Metropolitan Transportation Commission for allocation of Transportation Development Act (TDA) Article 3 funds for bicycle detection at signalized intersections along Hopyard Road and Owens Drive

8. Waive second reading and adopt Ordinance No. 2035 approving the application of BRE Properties, Inc., for a PUD Development Plan to construct a mixed-use High-Density residential/commercial development containing 251 residential units, 4 live/work units and approximately 5,700 square feet of retail space at the property located at the southeast corner of Owens Drive and Willow Road, as filed under Case No. PUD-85-08-12D

9. Waive second reading and adopt Ordinance No. 2036 approving the application of BRE Properties, Inc. for a PUD Development Plan to construct a mixed-use high-density residential/commercial development containing 247 residential units, 4 live/work units and a .55-acre public park on the property located at the northern corner of Gibraltar Drive and Hacienda Drive, as filed under Case No. PUD-81-30-86D

10. Waive second reading and adopt Ordinance No. 2037 approving amendments to the Phase I and Phase II Development Agreements between the City of Pleasanton and Prudential Insurance Company of America to (a) extend the term of the Development Agreement to five years from the dates of approval as filed under Case Nos. PUD-85-08-12D and PUD 81-30-86D; and (b) incorporate the Hacienda Transit Oriented Development standards and guidelines (P11-0856)

Public Hearing: P12-0042, City of Pleasanton – Consider an ordinance to amend Chapter 18.44: C Commercial Districts, Special Purpose-CC Central Commercial District of the Pleasanton Municipal Code to designate financial institutions as a conditional use within the Downtown Revitalization District (Continued from April 3, 2012)

18. Consider allocations for the FY 2012-13 Housing and Human Services Grant (HHSG) and Community Grant Programs

19. Public Hearing: Consider the FY 2012-13 Annual Action Plan for the use of Federal Community Development Block Grant (CDBG) Funds

Notice

There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders, which require a hearing by law, the receipt of evidence, and the exercise of discretion.  The 90-day limit begins on the date the decision is final (Code of Civil Procedure § 1094.6).  Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code §65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing.  The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting.  For information on the next regular or special City Council meeting, please call (925) 931-5027 or visit the website at www.ci.pleasanton.ca.us.
