1. Approve regular meeting minutes of April 17, 2012
2. Adopt a resolution of intent and introduction of an ordinance to amend the contract between California Public Employees’ Retirement System (CalPERS) and the City of Pleasanton to provide Section 20475 (Different Level of Benefits), Section 21363.1 (3% @ 55 Full Formula) and Section 20037 (Three-Year Final Compensation) providing a second tier of retirement benefits for new Police Officers’ Association (POA) employees

4. Accept or appeal actions of the Zoning Administrator and Planning Commission
5. Review and approve Engineer’s Report and Budget, and set public hearing for 2012-13 annual assessments for Lighting and Landscape Maintenance Districts 1984-1 (Ponderosa-Del Prado); 1993-1 (Windsor); 1993-2 (Bonde Ranch); 1994-1 (Oak Tree Farm); and 1995-1 (Moller Ranch)
6. Approve plans and specifications, review bids, and award contract to Rosas Brothers Construction in the amount of $178,467 for the Annual Curb and Gutter Replacement for Street Resurfacing project, CIP No. 115009
7. Waive second reading and adopt Ordinance No. 2039 to amend Chapter 18.44: C Commercial Districts, Special Purpose-CC Central Commercial District of the Pleasanton Municipal Code to designate financial institutions as a conditional use within the Downtown Revitalization District

10. Approve financial participation in i-GATE Innovation Hub for fiscal year 2012-2013

11. Adopt a resolution accepting the Midyear Budget for the 2011/12FY Capital Improvement Program (CIP) and amending the 2011/12FY CIP accordingly

Continued council deliberation and action regarding the appeal by Councilmember Sullivan of the Planning Commission’s decision denying the appeal of Angela Joe-Willmes and Linda Martin, thereby upholding the Director of Community Development’s approval of a zoning certificate to operate a supermarket as a permitted use within the existing building located at 3112 Santa Rita Road, and within the hours of operation and delivery limits as set forth in the existing Conditions of Approval for PUD-84 (Ordinances 1035, 1165 & 1214 and Planning Commission Resolution 2691) 5/7/12 Agenda Report
16. Public Hearing: P11-0731, Carl Pretzel (Appellant); Robert Baker (Applicant) – Consider an appeal of a Planning Commission decision approving an Administrative Design Review to construct an approximately 74-foot long fence, varying in height from 72 inches to 83 inches between 3647 and 3633 Glacier Court North
17. Authorize the City Manager to execute a contract with Alameda County to provide water and sewer maintenance services for the Castlewood Service Area for fiscal year 12-13
18. Consider the scope, work plan, general schedule and public input process for preparation of an East Pleasanton Specific Plan

Notice
There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders, which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure § 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code §65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting.
