Public Hearing: PUD-81-28-05M, City of Pleasanton Consider an application for a major modification to an existing PUD development plan to consider whether an existing six-foot tall masonry wall along a portion of the westerly property line between Pleasanton Station and Hap’s Restaurant should be retained or removed. The property is located at 30 W. Neal Street. Zoning for the property is PUD-C-O (Planned Unit Development Commercial Office) District, Downtown Revitalization District, Core Area Overlay District.

7. Approve plans and specifications, review of bid and award of contract to John D. Baker Construction Company in the amount of $416,000 for traffic signal installation at the intersection of Bernal Avenue and I-680 freeway s/b off-ramp, CIP No. 005068, and completion of the traffic signal system at Vineyard Avenue and Pietronave Lane, CIP No. 075014
8. Approve a consultant agreement with Kimley-Horn & Associates in the amount of $111,684 to provide design and engineering services for the Santa Rita Road and Valley Avenue Widening Improvements, CIP No. 975039
9. Accept public improvements performed by Gateway Pacific Contractors, Inc. for the City's Turnout No. 6 project in the Vineyard Corridor Specific Plan area, CIP No. 011023-T.O.
10. Accept public improvements performed by O'Grady Paving, Inc. for Vineyard Avenue Median Streetscape Improvements, CIP No. 055031 and adopt a resolution designating the area on Vineyard Avenue 400 feet west and 250 feet east of Cereza Drive as a four-hour parking zone
11. Accept public improvements performed by DeSilva Gates Construction for Resurfacing of Various City Streets, CIP No. 075003

PUBLIC HEARINGS AND OTHER MATTERS
13. (Aspects of this item are currently pending in the Alameda County Superior Court and a decision from the Court bearing on this item is anticipated to be received prior to March 4. The item is being placed on the agenda as a placeholder so that the City Council could take action depending on the outcome of the court case.) Receive the City Clerk’s Certification of the Referendum Petition with respect to Ordinance No. 1961 approving the application of James Tong, Charter Properties (Oak Grove Development) for PUD plan approval, as filed under Case PUD-33 and considerer various options/resolutions concerning the petition including whether to rescind the ordinance or call for an election and, if an election is called, to adopt ballot language, request the County to consolidate the election with the State primary election on June 3, and establish dates for arguments/rebuttal arguments in favor of and in opposition to the referendum
14. Public Hearing: PAP-110, Dennis Long, Appellant (PADR-1698, Scott Smith, Applicant) – Consider an appeal of the Planning Commission’s denial of an appeal of the Zoning Administrator’s approval of an application for administrative design review to construct an approximately 64-square-foot first-floor addition to the left side and an approximately 273-square-foot second-floor addition to the right side of the existing residence located at 3496 Whitehall Court. Zoning for the property is R-1-6,500 (Single-Family Residential) District

Notice
There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders, which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure § 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code §65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting.
