5. Continued Public Hearing: PUD-32, Daniel and Belinda Sarich -- Consider an application for Planned Unit Development (PUD) development plan approval to subdivide an approximately 20-acre site into two single-family residential lots: (1) an approximately one-acre parcel which would include the existing residence and a new detached two-car garage; and (2) an approximately 19-acre parcel which would include:(a) an approximately 9,990-square-foot, two-story home with a 3,150-square-foot habitable basement with second unit; (b) a 1,785-square-foot five-car attached garage; (c) a 660-square-foot cabana; (d) a 165-square-foot pool bathroom; and (e) a 165-square-foot greenhouse. The property is located at 5 Tuscany Place (formerly 1630 Vineyard Avenue), in the Vineyard Avenue Corridor Specific Plan Area, and is zoned PUD-LDR/HR/OS (Planned Unit Development – Low Density Residential/Hillside Residential/Open Space) District.

There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders, which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure § 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code §65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting.
